Your Acceptance
These Terms of Service (“Terms”) govern your access to and use of all mobile games (the “Games”) offered by BOBAFRIENDS (“we,” “us,” or “our”). By downloading, installing, or playing any of our Games, you agree to be bound by these Terms. If you do not agree to any of these terms, then you must immediately discontinue your use of our Games.
Unless applicable laws require us to obtain your consent in a different way, you consent to us using your personal information in the ways and for the purposes described in our Privacy Policy.
License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and play the Games on devices that you own or control, solely for your personal, non-commercial entertainment. All rights not expressly granted are reserved by BOBAFRIENDS.
User Conduct
You agree not to use the Games for any unlawful purpose or in any manner that could damage, disable, overburden, or impair our servers or networks. You may not reverse-engineer, decompile, or disassemble any portion of the Games, nor attempt to gain unauthorized access to any part of the Games, other players’ accounts, or any systems or networks related to the Games.
Advertising
The Games are supported by advertisements served via Google AdMob. You may reset or limit ad tracking through your device settings; to opt out of analytics, you may uninstall the Games.
Intellectual Property
All content, designs, graphics, text, logos, and software displayed in the Games are owned or licensed by BOBAFRIENDS and protected by copyright, trademark, and other intellectual property laws. You acknowledge that no title or ownership in the Games or any associated content is transferred to you, and you may not use our trademarks, logos, or service marks without our prior written permission.
Third-Party Services
We may integrate third-party SDKs or services (for analytics, advertising, crash reporting, etc.) into our Games. Your use of those services is subject to the third parties’ terms and policies. We are not responsible for their practices.
Disclaimers
THE GAMES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOBAFRIENDS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE GAMES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE GAMES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID FOR IN-GAME PURCHASES IN THE 12 MONTHS PRIOR TO THE CLAIM.
Indemnification
You agree to defend, indemnify, and hold BOBAFRIENDS and its officers, directors, employees, and agents harmless from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Games.
Termination
We may suspend or terminate your access to the Games at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to us or other users. Upon termination, your license to use the Games will immediately cease.
Changes to These Terms
We may revise these Terms at any time by posting an updated version in the Games or on our website. We will update the “Last Updated” date above. Your continued use of the Games after such changes constitutes your acceptance of the new Terms.
